Consumer Collections

We have a substantial consumer collections department that specializes in credit card and automobile deficiency accounts. Our approach is to maximize recoveries while minimizing the time and cost needed to attain those recoveries. We employ the latest technology and collection techniques to achieve this goal. And we keep our clients up to date on the actions we are taking on a regular basis.

Upon receipt and review of an account, we immediately issue a demand letter and undertake telephone collection activity. This early and frequent contact enables us to maximize recoveries without the need for the client to incur additional costs. If the intial activity is unsuccessful in resolving the account, we will review the account to determine if circumstances warrant the filing of suit. If so, we initiate suit. We also continue telephone collection activity during the suit process. Once judgment is obtained, we undertake appropriate post judgment collection measures including wage garnishments, bank levies, liens on real estate, etc.

All of our cases are handled and tracked utilizing Collection Partner software from Jim Hubbard Systems Inc. of Birmingham, Alabama. This powerful software enables us to have multiple parties to work or monitor an account by providing simultaneous access to account and history information. It also handles all accounting, document production, and client reporting functions. Clients can place accounts manually, by spreadsheet or electronically through a direct electronic interface. We can arrange for clients to have direct on-line access to their account status and information utilizing any internet connection.

Our collection personnel are divided into three Units. The Legal Unit monitors all activity on the account. They review the files on a regular basis to insure that we are taking all appropriate actions in a timely manner. They are also the point of contact for client questions or directions so you will be able to speak directly to a person familiar with your files.

The Call Unit handles all incoming and outgoing debtor calls. The firm utilizes a predictive dialing system from Predictability Plus to maximize the number of calls and debtor contacts. Call Unit personnel are trained in effective collection techniques.

The Information Unit are dedicated skip tracers assigned to find current address, telephone, asset and employment information. To acquire this information, this unit utilizes multiple credit bureaus, online search engines, public records databases and paid information sources including, Experian and Transunion credit bureaus, Lexis Public Records Service, Accurint, TSYS IDInfo service, and multiple internet resources. All collection personnel are trained on and monitored for compliance with the Fair Debt Collection Practices Act.

Most matters are handled on a contingency basis. We advance costs and bill our clients monthly for reimbursement. We defend counterclaims and claims against financial institutions on an hourly basis.



Replevin/Confiscation

We represent creditors in replevin and confiscation claims. These matters are generally handled on a time or flat fee basis. Flat fee proposals will be submitted upon request. We understand that the essential element in these cases is prompt response. We are prepared to move immediately to assist our clients to obtain a quick return of their collateral.



Consumer Bankruptcy

We represent only creditors in commercial and consumer bankruptcies. We respond quickly to clients’ requests for relief motions, objections to confirmations, objections to discharge and cash collateral protection. We assist our clients in analyzing the desired result and work aggressively toward that end. Especially in consumer matters, we make use of paralegal support to keep legal fees to a minimum. We offer this service on a time or flat fee basis.



Mortgage Foreclosure

We represent first and subsequent mortgagees in foreclosure matters in Delaware. We pride ourselves on the prompt accomplishment of each step of the process from the fling of the complaint to the ultimate sale. These services are also available on an hourly basis or a negotiated flat fee.



Litigation

We have vast experience in both commercial and consumer litigation, including loan workouts and defense of claims brought by commercial borrowers and consumers. Here again we use a team approach, delegating each task to the individual who can handle it competently and at the lowest cost to the client. Generally, litigation matters are handled on an hourly basis.



Commercial Loans and Real Estate

We are prepared to assist you in documenting loan transactions secured by personal and real property. We understand that loan closings are a time sensitive issue with our clients. Our goal is to assist with and expedite the process.
